Olivia Privacy Policy

1. Who We Are

Olivia is a product of DEV AI INC. (“Dev AI”, “we”, “us”), headquartered at 626 – 7771 Alderbridge Way, Richmond, BC, Canada, V6X 2A4. This Privacy Policy explains how we collect, use, disclose, and safeguard personal information when you interact with the Olivia platform, websites, mobile or desktop applications, APIs, and related services (collectively, the “Service”).

By creating an account, accessing the Service, or otherwise providing personal information to us, you agree to the practices described in this Privacy Policy. If you do not agree, please refrain from using the Service.

2. Information We Collect

We collect information in three main ways: (a) directly from you, (b) automatically through use of the Service, and (c) from third-party sources. The categories of personal information we collect include:

Account & profile data: name, email address, password (hashed), avatar, organization affiliation, and role.

Workspace & content data: creative assets, files, chat messages, prompts, annotations, comments, and other content uploaded, generated, or shared within Olivia workspaces. You control what you upload and share.

Usage & telemetry data: product interaction events, device and browser information, log data, IP address, approximate location, and diagnostic information that helps us maintain and improve the Service.

Integrations & third-party data: if you connect Olivia to external services (e.g., Google, OpenAI, or other content repositories), we receive information necessary to enable the integration, subject to your authorization.

Google Drive data: if you choose to connect Google Drive, Olivia may access Drive file names, folder names, file IDs, MIME types, thumbnails, image dimensions, and the contents of files you select or import, only as needed to let you browse Drive and bring selected assets into Olivia.

Support & communications data: information contained in tickets, emails, chat support conversations, surveys, or feedback submissions.

3. How We Use Personal Information

We use personal information only for legitimate and authorized purposes, including to:

Provide, operate, and maintain the Service, including collaboration workspaces and creative tooling.

Process transactions and manage billing, subscriptions, and account administration.

Deliver customer support, respond to requests, and communicate product updates, security alerts, and service announcements.

Monitor platform performance, conduct analytics, improve functionality, and develop new features and experiences.

Secure the Service, prevent fraud or misuse, and enforce our Terms of Service and other agreements.

Comply with applicable laws, regulations, legal processes, or enforceable governmental requests.

4. Legal Bases for Processing (EEA/UK)

Where the EU General Data Protection Regulation (“GDPR”) or UK GDPR applies, we process personal data under one or more of the following legal bases:

Contractual necessity – to provide the Service you or your organization requested.

Legitimate interests – to secure, improve, and grow our business in a way that does not override your rights.

Consent – where required for activities like certain marketing or optional integrations. You may withdraw consent at any time.

Legal obligation – to comply with laws, regulations, or lawful requests.

5. Sharing & Disclosure

We do not sell personal information. We share personal information only with:

Service providers & subprocessors who support hosting, data storage, analytics, communications, security, payment processing, and customer success. They process data only on our behalf and under confidentiality obligations.

Integration partners

when you or your organization connect Olivia to external tools. The data shared is limited to what is required to enable the integration.

Professional advisors (lawyers, auditors, insurers) where necessary to protect our legitimate interests.

Authorities or legal requests when required to comply with the law or respond to valid legal process, or when disclosure is necessary to protect our rights, your safety, or the safety of others.

Corporate transactions in connection with a merger, acquisition, financing, or sale of all or part of our business, subject to confidentiality safeguards.

6. AI Processing & Generated Content

Olivia leverages AI models from trusted providers to create, transform, or enhance creative assets. When you submit prompts, reference materials, or other content for AI-assisted features, the data may be securely transmitted to and processed by third-party AI providers (e.g., OpenAI, Google, Anthropic, or other authorized vendors) solely to fulfill your request. We contractually require these providers to maintain confidentiality, restrict data usage to service delivery, and prevent training on your data unless you explicitly opt in where applicable.

7. Google Drive Integration & Google User Data

Google Drive is an optional integration. Olivia uses Google Drive access only after you intentionally connect your Google account and grant permission through Google’s OAuth consent flow.

Purpose: Olivia uses Google Drive access to display your folders and image files, show file metadata and previews, and import files you choose into your Olivia asset library or canvas.

Read-only access: Olivia does not create, edit, delete, move, rename, or change sharing permissions for files in your Google Drive.

Storage: Olivia stores the OAuth token needed to maintain the connection and may store imported copies of files, thumbnails, file names, file IDs, source metadata, and related workspace records so the selected assets remain available in your Olivia workspace.

Use limitations: Olivia does not sell Google user data, use Google Drive data for advertising, or use Google Drive data to train AI models unless you separately and explicitly choose a feature that sends selected content to an AI provider to fulfill your request.

Deletion and disconnection: you can disconnect Google Drive from Olivia and request deletion of imported Google Drive assets or related workspace data by contacting us at engineering@tryolivia.ai.

Olivia’s use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

8. Meta Ads Integration & Meta User Data

Meta Ads is an optional integration. Olivia uses Meta Ads access only after a user intentionally connects their Meta or Facebook account and grants permission through Meta’s OAuth consent flow.

Olivia may access read-only advertising account information, campaigns, ad sets, ads, creative previews, delivery status, performance metrics, insights, spend, impressions, clicks, conversions, and related action breakdowns made available through the permissions granted.

Olivia uses this data to display advertising performance, import read-only campaign and ad reporting, analyze which creatives and placements performed well, and help generate reporting, recommendations, and creative suggestions for the user’s organization.

Olivia currently uses Meta Ads access for reporting and analytics only. Olivia does not create, edit, publish, pause, delete, or otherwise manage ads, campaigns, ad sets, pages, pixels, or ad accounts through this integration.

Olivia stores the OAuth token needed to maintain the connection, associated Meta account identifiers, selected ad account records, campaign/ad/ad set metadata, creative preview references, synced insights, and related workspace records so reporting data remains available in the user’s Olivia workspace.

Olivia does not sell Meta Ads data, does not use Meta Ads data to target advertising outside the user’s workspace, and does not use Meta Ads data to train general-purpose AI models. Olivia may use aggregated, de-identified, or anonymized information to understand product usage and improve the Service, provided the data cannot reasonably identify a user, organization, or ad account.

Users can disconnect Meta Ads from Olivia and request deletion of imported Meta Ads data or related workspace data by contacting engineering@tryolivia.ai. Olivia also maintains a Meta data deletion callback at https://api.tryolivia.ai/api/meta/data-deletion

9. Cookies & Tracking Technologies

We and our partners use cookies, pixels, local storage, and similar technologies to recognize you, measure engagement, remember preferences, deliver analytics, and improve the Service. You can manage cookie preferences through your browser settings. Some features may rely on cookies; disabling them could impact functionality.

10. Data Retention

We retain personal information for as long as your organization maintains an active account or as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce agreements. We follow data minimization principles and delete or anonymize information when it is no longer required. Workspace owners can request deletion of specific assets or entire workspaces through in-product controls or by contacting us.

11. Security

We implement administrative, technical, and physical safeguards to protect personal information, including access controls, encryption in transit, network monitoring, secure development practices, regular backups, and vendor due diligence. However, no system can be completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your credentials.

12. International Data Transfers

DEV AI INC. operates globally. Personal information may be processed in Canada, the United States, the European Union, or other jurisdictions where we or our service providers operate. When transferring personal information internationally, we rely on lawful transfer mechanisms such as Standard Contractual Clauses, adequacy decisions, or your explicit consent.

13. Your Privacy Rights & Choices

Depending on where you reside, you may have rights regarding your personal information. These can include the right to:

Access, correct, or update personal information we hold about you.

Request deletion of personal information, subject to legal limitations.

Object to or restrict certain processing activities.

Receive a copy of your data in a portable format.

Opt out of marketing communications by using the unsubscribe links or contacting us.

Opt out of the “sale” or “sharing” of personal information, where applicable under state laws.

To exercise these rights, contact us at engineering@tryolivia.ai. We may need to verify your identity before fulfilling certain requests. If we process your information on behalf of an organization (e.g., your employer or client), please direct requests to that organization first.

14. Children’s Privacy

The Service is not directed to children under 13 years of age (or a higher age threshold where required by law). We do not knowingly collect personal information from children. If we learn that we have collected personal information from a child without appropriate consent, we will delete it promptly. If you believe a child has provided us with personal information, please contact us.

15. Changes to This Policy

We may update this Privacy Policy to reflect changes in technology, law, or our business practices. If we make material changes, we will notify you via email, in-product notice, or other appropriate means. The “Effective date” at the top will reflect the latest revision. Your continued use of the Service after notice constitutes acceptance of the updated policy.
